<turbo-stream action="update" targets=".modal[data-modal-name=&#39;atp-terms-of-service&#39;] .modal-title"><template>ATP Terms of Service</template></turbo-stream><turbo-stream action="update" targets=".modal[data-modal-name=&#39;atp-terms-of-service&#39;] .modal-body"><template><h3>THE WEB PROFESSIONAL INSTITUTE</h3><h2>Terms of Use for the WPI Learning Platform</h2><p><strong>Version 2.0.0 dated June 12, 2026</strong></p><p>The operator of the learning platform is <strong>WPI – Web Professional Institute GmbH</strong> (“WPI”), Edisonstraße 63, Building A, 12459 Berlin, Germany.</p><p>WPI and the respective Authorized Training Partner ("ATP")</p><ul class="default-ul"><li><p>GFN GmbH, Am Taubenfeld 10, 69123 Heidelberg, Germany </p></li></ul><p>are jointly responsible for the processing of your personal data within the scope of the WPI training and certification program (Art. 26 GDPR). The exact division of responsibilities as well as all other information regarding data protection can be found in our [Privacy Policy].</p><p>The following terms and conditions apply to the use of the WPI learning platform.</p><p>These Terms of Use establish a user relationship between you and WPI. Your ATP is the operational contact for your training and support matters within the WPI Training and Certification Program and is jointly responsible with WPI for the processing of your personal data (see [Privacy Policy]).</p><h3>1. Scope</h3><p>a) These Terms of Use govern the use of the WPI online learning platform (hereinafter: <strong>“Platform”</strong>) by all users, in particular course participants, trainers, and tutors (collectively “<strong>Users</strong>”).</p><p>b) By registering on the Platform, Users agree to these Terms of Use.</p><h3>2. Platform Services</h3><p>a) The Platform offers Users the opportunity to participate in learning and preparatory programs, communicate with other Users, and take WPI certification exams.</p><p>b) WPI is entitled to further develop the Platform and its services (e.g., adaptations to technical progress, improvements to user-friendliness, bug fixes, content updates), to the extent that this is reasonable considering the interests of the Users.</p><p>c) Significant changes that affect existing course enrollments or essential ways of using the platform will be announced to users via email or through the platform at least 30 days before they take effect. Users may object to the changes within 14 days of receiving the notice of change. In the event of an objection, the user relationship ends upon the change taking effect; certificates already purchased and courses already completed remain unaffected by this.</p><h3>3. Registration and Use</h3><p>a) Registration is required to use the platform.</p><p>b) Use of the platform is permitted only to persons who have reached the age of 16. Upon registration, users confirm that they are at least 16 years old.</p><p>c) Users are required to provide their full name truthfully and completely upon registration, to keep the information up to date, and to ensure correct spelling, as this will appear on certificates and diplomas.</p><p>d) Use of the platform requires a two-step registration process. Following the user’s initial registration, the responsible ATP will review and activate the account. Access to the platform is granted only after positive confirmation by the ATP.</p><p>e) Users shall treat their login credentials as confidential and shall not disclose them to third parties. They shall choose a secure password and change it if they suspect it has been compromised. If WPI offers multi-factor authentication, users should enable it.</p><p>f) If misuse is suspected, users must change their password immediately and notify the responsible ATP. Users are responsible for activities conducted under their login credentials, unless they are not at fault.</p><h3>4. General Rights and Obligations of Users</h3><p>a) Users are responsible for ensuring that the technical requirements for using the platform are met on their end. This includes a suitable device and a stable internet connection. The ATP is available to provide guidance, if needed, on the technical requirements for the planned course.</p><p>b) The platform may be used exclusively for learning purposes and within the scope of its intended functions. Any misuse or use contrary to its intended purpose is prohibited. Misuse includes, in particular:</p><ul class="default-ul">
<li><p>using the platform for one’s own commercial purposes;</p></li>
<li><p>behavior that interferes with other users, in particular harassment, threats, insults, or other violations of personal rights;</p></li>
<li><p>actions that may jeopardize the technical functionality or security of the platform, such as by introducing malware;</p></li>
<li><p>obtaining, distributing, or exploiting solutions to assignments or exam content;</p></li>
<li><p>the use of automated systems or scripts to access the platform or retrieve data, unless this has been expressly approved by WPI in writing.</p></li>
</ul><p>c) Users agree to treat all data of other users made available via the platform as strictly confidential and not to use it for their own purposes (e.g., advertising). The processing of other users’ personal data is permitted only within the scope of the functions provided by the platform, based on legal authorization, or with the express consent of the data subjects.</p><h3>5. Special Obligations of Learners</h3><p>a) Learners agree to</p><ul class="default-ul">
<li><p>actively contribute to their own learning success by conscientiously working through the learning content and contacting the relevant tutors or trainers if they have questions or encounter problems;</p></li>
<li><p>to complete exercises and, where applicable, assignments on time;</p></li>
<li><p>to take exams in accordance with the provisions of the currently applicable examination regulations.</p></li>
</ul><p>b) Learners may publish content on the platform provided that it is relevant to the learning process and does not violate any legal provisions or these Terms of Use.</p><h3>6. Specific Duties of Trainers and Tutors</h3><p>a) Trainers and tutors must have successfully completed the respective WPI certification in the subject area in which they prepare learners and possess a verifiable teaching qualification.</p><p>b) They are responsible for supervising the learners assigned to them and assisting them with questions and problems.</p><p>c) Trainers and tutors must enable the multi-factor authentication offered by WPI, provided it is available.</p><h3>7. Exam Confidentiality and Exam Integrity</h3><p>a) Specific exam content (exam questions, assignments, solution schemes, and grading rubrics) for WPI certification exams is confidential.</p><p>b) Users shall not attempt to obtain knowledge of exam content, nor shall they copy, disclose, or exploit it. If users accidentally become aware of exam content, they shall inform WPI immediately.</p><p>c) During exams, any form of cheating or gaining an unfair advantage (e.g., unauthorized aids, outside assistance, circumvention of exam procedures) is prohibited. Violations may result in the cancellation of the exam, the revocation of a certificate already issued, and the suspension of platform access, in accordance with the provisions of the examination regulations.</p><h3>8. Content on the Platform</h3><p>Users are personally responsible for the content they publish. In particular, content that</p><ul class="default-ul">
<li><p>violates applicable law or incites such violations;</p></li>
<li><p>discriminates, is offensive, or infringes on personal rights;</p></li>
<li><p>glorifies violence or incites criminal acts;</p></li>
<li><p>contains malware;</p></li>
<li><p>infringe upon the rights of third parties (e.g., copyrights, trademarks, or personal rights).</p></li>
</ul><h3>9. Copyright and Rights of Use</h3><p>a) All content provided on the platform, including text, images, graphics, logos, word and figurative marks, videos, and software, is protected by copyright. Components of the WPI curriculum that are published under an open-source license or another free license may be used in accordance with the respective license terms.</p><p>b) Upon registration, users receive a simple, non-transferable right of use to the platform content that is not openly licensed. This right is limited to the duration of the membership and permits exclusively private, non-commercial use within the scope of learning activities. In particular:</p><ul class="default-ul">
<li><p>The content may only be used for personal learning purposes.</p></li>
<li><p>Sharing with third parties is not permitted.</p></li>
<li><p>The content may not be altered, edited, or modified.</p></li>
<li><p>Any form of commercial use is prohibited.</p></li>
<li><p>Downloads are permitted only to the extent allowed by the platform’s functions.</p></li>
</ul><p>c) For contributions that users create on the platform (e.g., forum posts, solutions, comments), they grant WPI and other platform users a simple, non-exclusive right of use limited to the term of the agreement plus a transition period of up to 12 months for the following purposes:</p><ul class="default-ul">
<li><p>Use within the scope of the platform functions,</p></li>
<li><p>use for group work and learning activities,</p></li>
<li><p>internal evaluation to improve learning and examination offerings,</p></li>
<li><p>storage and technical processing.</p></li>
</ul><p>Any use beyond this scope, in particular public distribution or commercial exploitation, requires the express consent of the respective rights holders.</p><h3>10. Coursework, Exams, and Certificates</h3><p>Participation in preparatory courses and WPI certification exams is subject to the current WPI examination regulations (<a class="external_url" target="_blank" rel="noopener noreferrer nofollow" href="https://wpicert.org/exam-regulations">https://wpicert.org/exam-regulations</a>), to which users agree by registering.</p><h3>11. Data Protection</h3><p>WPI is committed to a high standard of data protection and complies with the European General Data Protection Regulation (GDPR) as well as applicable national data protection laws. Detailed information regarding the processing of your personal data, including the specific legal bases, recipients, and retention periods, can be found in our [Privacy Policy].</p><h3>12. Availability</h3><p>a) WPI strives to ensure the highest possible availability of the platform but cannot guarantee uninterrupted availability. Maintenance work, technical malfunctions, or force majeure events may temporarily result in restrictions or interruptions.</p><p>b) Maintenance work is carried out outside of peak usage times whenever possible. In the event of longer planned interruptions, WPI will inform users in a timely manner via email or through the platform.</p><p>c) In the event of platform interruptions during an exam, the provisions of the examination regulations apply.</p><h3>13. Liability</h3><p>a) WPI and ATP shall be liable without limitation for damages resulting from injury to life, limb, or health caused by an intentional or negligent breach of duty. The same applies to other damages resulting from an intentional or grossly negligent breach of duty.</p><p>b) In the event of a breach of material contractual obligations (cardinal obligations), WPI and ATP are also liable for slight negligence, but only for foreseeable damages typical to the contract. Essential contractual obligations are those whose fulfillment is essential for the proper performance of the contract and on whose compliance users may regularly rely.</p><p>c) No further liability exists. The limitations of liability also apply to legal representatives and vicarious agents of WPI and ATP. Mandatory statutory liability provisions, in particular under the Product Liability Act, remain unaffected.</p><p>d) To the extent that WPI and ATP are jointly liable, they are jointly and severally liable; internally, liability is determined by their respective allocation of duties.</p><p>e) <strong>User-generated content:</strong> WPI does not conduct any prior editorial review of user-generated content. Liability for this content exists only within the scope of mandatory statutory provisions. Upon becoming aware of specific legal violations, WPI will review the relevant content and, if the violation is confirmed, will immediately remove it or block access to it. WPI provides a reporting system for this purpose and reserves the right to conduct random checks.</p><p>f) <strong>Learning Content:</strong> WPI creates the learning content and course materials with the utmost care and updates them regularly in accordance with the current state of science and technology. WPI guarantees that the essential learning content is factually correct and suitable for the agreed-upon learning purpose. WPI assumes no liability for the accuracy, completeness, or timeliness of supplementary information, such as further links, discussion posts, or additional resources. Obvious errors in the learning content will be corrected immediately upon discovery. Users are encouraged to report any errors they find or suggest improvements.</p><h3>14. Rights in Case of Violations</h3><p>a) In the event of violations of these Terms of Use, WPI and the responsible ATP are entitled to exclude the respective users from using the platform with immediate effect.</p><p>b) Serious violations include, in particular:</p><ul class="default-ul">
<li><p>Misuse of the platform,</p></li>
<li><p>Disclosure of access data to third parties,</p></li>
<li><p>Infringement of copyrights,</p></li>
<li><p>significant disruption to other users,</p></li>
<li><p>cheating on exams, unauthorized acquisition or disclosure of exam content, plagiarism, or comparable violations of the examination regulations.</p></li>
</ul><p>c) When deciding on an exclusion, WPI and ATP shall take into account the circumstances of the individual case and the legitimate interests of the users. In the case of less serious violations, a warning is generally issued first.</p><h3>15. Term of the Agreement and Termination</h3><p>a) The user relationship is entered into for an indefinite period and may be terminated by either party at any time without stating reasons.</p><p>b) Users may terminate the user relationship by deleting their account or by notifying WPI in writing. Termination has no effect on certificates already obtained or courses already completed. The provisions regarding data storage in accordance with our [Privacy Policy] remain unaffected.</p><h3>16. Governing Law</h3><p>a) These Terms of Use are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods.</p><p>b) If the user is a consumer with habitual residence abroad, this choice of law applies only to the extent that it does not conflict with mandatory consumer protection provisions of the law of the country of residence.</p><h3>17. Final Provisions</h3><p>Should any provision of these Terms of Use be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that most closely approximates the economic purpose of the invalid provision.</p></template></turbo-stream>
